Update: Police arrest Charlottesville woman for abduction, assault of wife of Delegate David Toscano

Citing a conflict of interest, Charlottesville Commonwealth’s Attorney Dave Chapman has recused his office from prosecuting the woman charged with breaking and entering, abduction, and malicious wounding in an incident involving State Delegate David Toscano’s wife Nancy Tramontin on Monday, February 24.

“I have known David and Nancy for many, many years and have ties to David politically,” said Chapman. “It’s not appropriate for my office to be involved.” Fluvanna County Commonwealth’s Attorney Jeff Haislip, who handled last year’s prosecution of former Albemarle County Supervisor Chris Dumler, has been appointed special prosecutor, Chapman said.

Tramontin’s alleged assailant, 35-year-old Claire L.K. Kennedy Ogilvie, is employed by William Monroe High School in Greene County, and her Twitter account describes her as “a biology, chemistry & physics teacher and recovering attorney.”

The day after the incident, Toscano released a statement saying that he and Tramontin knew Ogilvie and that they had not seen her for a year. After breaking into Toscano and Tramontin’s Evergreen Avenue home, Toscano wrote, Ogilvie struck Tramontin in the head several times. Toscano drove his wife to the hospital when he arrived home from Richmond, he said. The couple’s high school aged son was not at home at the time of the alleged incident.

Ogilvie was arrested at her Park Street apartment on February 25 and is being held at the Charlottesville Albemarle Regional Jail

According to her LinkedIn profile, Ogilvie attended Yale University, The George Washington School of Law, and the University of Virginia and taught at The Peabody School, an elementary and middle school for gifted students. The profile also lists employment with the Semester at Sea as a tutor and instructor from 2009-10. Toscano was aboard UVA’s educational cruise ship in the fall of 2010  when he taught a sociology course.

In addition to describing her passion for travel, Ogilvie’s Green County Schools bio offers evidence that she’s a trivia buff: “I have also been on two game shows (Jeopardy! and Who Wants to be a Millionaire?) and am looking for any new opportunities for future tv appearances!”

Ogilvie, who cited assets of $7,200 and a $2,800 per month income, according to court records, is not considered indigent but refused to retain counsel during her first court appearance on Tuesday, February 25. She was ordered held without bond, and, as a result, the court appointed an attorney with a filing explaining, “the ends of justice require the appointment of counsel.” Ogilvie’s court-appointed attorney, Adam Rhea, did not immediately return C-VILLE’s call.

A Charlottesville woman has been arrested and charged with burglary, abduction, and malicious wounding after breaking into the city home of Delegate David Toscano and attacking the representative’s wife, according to police.

Police say Claire Kennedy Ogilvie, 35, broke into the Toscano home on February 24, according to a police press release. Toscano’s wife suffered non-life-threatening injuries, was treated at Martha Jefferson Hospital, and was later released.

Ogilvie is being held without bond at the Albemarle Charlottesville Regional Jail. According to a LinkedIn profile with a name and photo appearing to match her mugshot, Ogilvie attended Yale University, The George Washington School of Law and the University of Virginia and taught at The Peabody School, an elementary and middle school for gifted students. A Twitter account profile accompanied by a photo, the name ClaireKennedyOgilvie and the handle @elixir_o_life describes her as “a biology, chemistry & physics teacher and recovering attorney. I love to travel and have been to 50 countries, 6 continents and counting! ”

The assault charge was verified and detailed further in a press release from Toscano sent to reporters Tuesday afternoon:

My wife was assaulted at our home last evening by a person who we knew but had not seen for over a year. She was struck by her female assailant in the head several times but never lost consciousness. The assailant broke into our home. Our son was not home at the time.

I returned from Richmond and brought her to the hospital. She was treated and released and is resting comfortably. A full recovery from her injuries is expected.

The assailant has been apprehended and detained.

Since there is an ongoing investigation, we will have no further comment at this time. We hope that our privacy will be respected, and we appreciate people keeping us in their thoughts.
