Early birds: Charlottesville and Albemarle see record-setting turnout

There’s a line outside the City Hall Annex. Volunteers wearing cardboard posters of ballots circle cheerfully. This year, election season started early.

In Charlottesville, as of October 26, about 14,500 people have voted—a huge increase from the 3,394 total absentee ballots cast in 2016. Roughly 33,000 ballots have been cast this year in Albemarle County, where just 7,317 absentee ballots were cast in 2016. Two million Virginians, and more than 60 million Americans, have already pulled the polling lever.

“In Virginia, this was always going to be a very high-turnout election year,” says Miles Coleman, associate editor for Sabato’s Crystal Ball at UVA’s Center for Politics. “I think we saw some evidence of that even if you look at some of the off years—when Governor [Ralph] Northam was first elected in 2017—the turnout in northern Virginia really was much more than we were used to seeing.”

Virginia is among several states across the country that have sought to make early voting easier during the COVID-19 pandemic. The commonwealth has removed the requirement that mail-in ballots be signed by a witness, and allowed all voters to take advantage of curbside voting, for example. Other initiatives to make voting easier originated in the Democrat-controlled General Assembly this year. The legislature extended the deadline for when absentee ballots can be accepted and lifted long-standing restrictions on absentee voting, which required voters to claim one of several listed excuses to be eligible to vote early.

In Charlottesville, an average of 325 to 400 voters per day have cast their ballots in-person at the City Hall Annex since early voting began, according to Melissa Morton, Charlottesville’s director of elections and general registrar. Morton says the average wait time to vote in-person has been between 15 and 30 minutes, but adds that Fridays have been especially busy, with wait times as long as 45 to 75 minutes.

“We only had two voters who refused to wear masks,” says Morton. “Other voters, and our staff, offered the person a mask but he refused. After the voter voted, our staff disinfected the voting room.”

As of October 24, the City’s Walker Precinct, which makes up the northernmost portion of Charlottesville, was leading in early voter turnout with 2,222 ballots cast. The Venable and Buford precincts, where many off-Grounds UVA students reside, have seen the lowest turnout totals so far with 732 and 879 ballots cast, respectively. This trend generally mirrors the early voter pattern of 2016, although significantly more early votes have been cast across all precincts in Charlottesville this year.

Meanwhile, in Albemarle County, General Registrar of Voters Jake Washburne says early voting turnout so far has represented “a paradigm shift in voting behavior” for the County. Six-hundred to 850 voters have turned out each day to vote in-person at the 5th Street County Office Building. Washburne adds that most people have so far only had to wait five or 10 minutes to cast their ballots in-person.

“Even if the pandemic had not struck, I think we would’ve seen a significant increase in the number of people who would early vote [this year],” says Washburne. “But come COVID, that was like the one-two punch—I think a whole lot of people are concerned about going to a crowded polling place on Election Day with the virus still about.”

One caveat to the voting explosion is that new-voter registrations have declined sharply in Albemarle County compared to previous cycles. Washburne says that in 2016, 3,500 voters registered in the county between August and the registration deadline. That same time frame this year has seen just 1,800 new registrants. Washburne speculates that this decline, which has been especially notable in the precincts near the university, is the result of pandemic-hampered voter registration efforts and students re-registering to vote in their hometowns if they are taking online classes from home.

Nonetheless, voter registration and get-out-the-vote activism has continued on Grounds, says Kiera Goddu, a UVA fourth-year and president of the University Democrats.

“I’ve been taking one first-year [student] at a time—masked and windows down—to the Albemarle registrar’s office, and there have been other drivers who’ve been doing the Charlottesville registrar’s office so that students can vote early in-person and just kind of have it checked off,” says Goddu. “Especially during that period when [COVID-19] cases were at their worst at UVA, and students were most panicked that they wouldn’t be able to stay in their [on-Grounds] housing situation.”

Goddu says the University Democrats have also hosted limited in-person voter registration events twice a week since September. Setting up camp outside the Observatory Hill dining hall, the group registered almost 100 new voters in a single day just before the registration deadline earlier this month.

It’s hard to be sure what all this early voting will mean for election outcomes. Although preliminary estimates show that the surge in early voting across the country may favor Democrats, Coleman says he’d “be cautious [about] reading too much into the early vote.”

“It’s sort of the same way on election night—you don’t want to project a result when there’s only a small fraction of the vote that’s in,” he says.

“The Democrats, of course, have been telling their voters to vote earlier. Contrast that to Trump, who’s very, shall we say, skeptical of the early vote,” says Coleman. “What if it’s a rainy day? What if the virus gets much worse this next week before Election Day? So the Republicans, specifically Trump in encouraging his voters to wait, it could pay off, but it’s also a very risky strategy.”

In Virginia, early voting will continue through Saturday, October 31. On Election Day, polls open at 6am and close at 7pm.

Georgia fell under the notoriety spotlight for removing an estimated 107,000 voters from its rolls in a tight election year under the state’s “use it or lose it” law, which starts the process if a voter skips one election.

In Virginia, if you get a notice from the state Department of Elections asking if you’ve moved from the address used to register and don’t respond, you could find yourself purged from the voter rolls —although it will take a few years for that to happen.

People are typically taken off the list of registered voters if they move or die. “If a local registrar gets a notification from a reliable source, the Department of Elections will send a notice to ask if you’ve moved,” says Albemarle registrar Jake Washburne.

A reliable source includes the U.S. Postal Service, which provides the names of those who have filed forwarding addresses. Social Security and Vital Records let the elections department know about deaths, and courts report felony convictions and adjudications of incompetency.

If the voter does not respond to the notice asking if she’s moved, that voter is put on the inactive list, says Washburne, and is purged if she doesn’t show up to vote in two successive federal elections.

The purges are done in odd-numbered years after the federal elections and they’re done by the state, says Charlottesville Registrar Rosanna Bencoach.

According to state voter registration statistics for 2017, the elections department purged 3,272 Albemarle voters, 685 of whom died and 1,467 moved out of state. In Charlottesville, the state  purged 3,975 voters. Of those, 233 were deaths and 978 moved out of state.

In brief: Shifting precincts, hefty raise, murky water and more

Know your polling place

It’s been an eventful couple years, and if you want to speak up when it matters (by voting in the midterms on November 6) your deadline to register is October 15. With that in mind, we also want to remind 15,000 voters in Albemarle County that their polling places have changed.

The county has added three new precincts and folded the Belfield precinct into Jack Jouett, says Albemarle registrar Jake Washburne.

Split are Cale, which begat the new Biscuit Run precinct; Crozet and Brownsville, which gave birth to Mechums River; and Free Bridge, which adds Pantops precinct.

And voters in the University precinct who had cast ballots at the soon-to-be demolished U Hall will now do so at Slaughter Rec Center.

The splits will make Election Day lines more manageable, says Washburne, and there’s another deadline he’s considering: “After February 1, 2019, we can’t change any precincts until after the 2020 presidential election.”

Some are predicting massive turnout in November. Compared to last September, Albemarle has added 2,000 voters. And Washburne mailed over 700 ballots on the first day of absentee voting, compared to 94 on the first day of the last midterm election in 2014. 

In the city, registrar Rosanna Bencoach says there’s always a surge of registrations in September and October from the student population. But according to the state elections website, Charlottesville has 922 more active voters as of October 1 than it did a year ago.

Bencoach issues a caveat to would-be voters: Don’t wait until the last minute to register or to request an absentee ballot, which must be applied for by 5pm the Tuesday before the election.

“With the current postal delivery practices, that’s way too late,” she says.

City Council appointed Brian Wheeler interim clerk of council at its October 1 meeting. The current city spokesperson and former editor of Charlottesville Tomorrow temporarily replaces Paige Rice, who resigned last month. Since starting with the city in February at $98,000, raises have upped Wheeler’s pay to $116,438, an 8 percent increase in less than a year.

A12 anniversary costs add up

Charlottesville spent $921,334 over the August 12 anniversary weekend putting downtown on lockdown, and the University of Virginia reports its costs were $422,981. Adding the Virginia State Police’s expenses of $3.1 million, that puts the police-heavy weekend at around $4.4 million—and that’s not including Albemarle County’s costs.

Indigenous Peoples Day

“We have been categorized as people of the past,” Karenne Wood, an enrolled member of the Monacan Indian Nation, told C-VILLE in March. She pointed out that in school textbooks, American Indians are often written about in the past tense: They lived in this type of house; they ate squash and corn; they wore feathers.

But she also hopes those textbooks will tell the story of Virginia Indians present and future. For Wood, director of Virginia Indian Programs at Virginia Humanities, that means working with textbook writers to tell a fuller—not just colonist—history of Native Americans. “We have adapted to live in this century along with everybody else,” she says.

To acknowledge their history on Indigenous Peoples Day, and to give a native perspective on how the story of Virginia’s first people can be expanded, Wood will give a talk called “Stone, Bone, and Clay: Virginia Indians’ History of 18,000 Years” on Monday, October 8, from 6:30-8pm at Lane Auditorium in the Albemarle County Office Building.

Monacan tribal dancers will perform immediately following her presentation.

Can county officials remain unbiased for referendum vote?

The Albemarle County Board of Supervisors voted 4-2 July 6 to hold a $35 million bond referendum for school improvements in November, and some locals think county officials will not be able to educate the public about the new ballot item without advocating for it.

Virginia Code allows local governments to clarify a referendum, but insists they must remain neutral in their explanation. Former school board member Gary Grant says county officials may have already slipped up.

“A couple supervisors, in my opinion, have been advocating,” Grant says. “When, in my opinion, they shouldn’t be.”

He notes that Diantha McKeel, the supe who doubles as vice-chair of the board, said at the June 1 BOS meeting that it’s going to fall onto “the school system and the school board to get out to the community and really fight for [the referendum] and explain these projects.” She added, “What I’m hearing is the details can still be explained very clearly at the polling sites.”

Details McKeel referred to would denote specifically what the $35 million bond referendum will go toward—if it passes.

The biggest chunk—$15.2 million—will pay for a two-story addition and modernization of Woodbrook Elementary School, with $10.9 million proposed for learning space modernization across all schools, $6 million slated for a Western Albemarle High School addition and $2.9 million for school security improvements.

At the June 1 meeting, BOS chair Liz Palmer wanted to hang “great big things that you can read from a distance”—posters—inside the polling places to break down the $35 million for voters.

According to Grant, a former reporter at WINA and The Observer who talked with local Virginia Electoral Board member Clara Belle Wheeler, the Electoral Board will publish the wording of the referendum exactly as it appears on the ballot on posters and explanatory materials distributed inside the voting precinct. In her e-mail to Grant, Wheeler says, “No further explanation of any referendum is permitted.” Wheeler did not respond to an interview request.

Jake Washburne, with the county’s registrar of voters, says the code does allow additional explanatory information, however.

“They can’t say, ‘Rah rah rah, vote for this,’” Washburne says, but the governing body may provide
a neutral explanation of each referendum question in 500 words or less.

In his blog, Whatever Albemarle, Grant questions if, to be fair, supervisors will instruct staff to also hang “equally large ‘educational’ charts showing what the tax increase will be if a $35 million referendum passes” inside polling places. Not that he’s against the capital improvement projects, he says, as long as Virginia law is adhered to.

County attorney Greg Kamptner, who will write the question that appears on the ballot, did not respond to an interview request. He has, however, provided to county officials written legal guidance, which says the BOS may pass a resolution in support of or opposition to the referendum. Advocacy prohibitions also do not apply to county officials acting in their individual capacities, he says, or when they’re “off the clock,” Lee Catlin, assistant county executive for community relations, told Charlottesville Tomorrow.

Says Grant, “It’s going to be hard to police that.”

Registration pros and cons: GOP sues to keep felons from voting

As if a presidential election year weren’t exciting enough, about a month after Governor Terry McAuliffe signed his April 22 bombshell executive order restoring the voting rights of 206,000 felons, General Assembly Republican leaders filed a lawsuit to keep them out of the polls.

Voter registration has skyrocketed in 2016 from this time a year ago, and election officials are divided about whether it’s the nearly 5,000 felons who have registered statewide boosting the numbers.

Albemarle registrar Jake Washburne says the State Board of Elections told localities they don’t need to keep track of felon registration and his “ballpark guess” is that between 40 and 50 have registered to vote in the county, with 14 more on hold waiting to be cleared by the secretary of the commonwealth, who maintains a list of felons whose rights have been restored.

In Charlottesville, 32 felons have registered to vote since April 22 and 15 are pending, says registrar Rosanna Bencoach.

Local resident Clara Belle Wheeler is the Republican on the three-person State Board of Elections. “Literally five minutes after the pronouncement by the governor, registrars reported they had an influx of people around the commonwealth,” she says. “The registrars had no warning about this restoration notice. This member had no prior knowledge.”

It would have been prudent, says Wheeler, to keep those names in a separate file.  “Once a name is registered, it takes a great deal of time and paperwork to remove that name,” she says.

However, the same state board said felons could be entered in the state database, according to the two local registrars. “The State Board of Elections assured registrars that they can flag [felons] if they have to take them off,” says Bencoach.

Wheeler points out that two previous governors—Democrat Tim Kaine and Republican Bob McDonnell—thought about doing a blanket restoration. “Their attorneys general said, ‘No, you can’t. It’s not constitutional.’”

Not only did McAuliffe restore voting rights, but his order means felons can sit on juries and run for office, and restoring voting rights is the first step to gun ownership.

Now felons can get concealed carry gun permits, and “rapists can sit on a rape case jury, murderers can sit on juries,” says Wheeler.

Indeed, according to the lawsuit, a felon is running for mayor in Richmond and in a capital case in Dinwiddie, the defense has asked that felons be included in the jury pool.

Delegate Rob Bell, who is running for attorney general in 2017, has no problem with McAuliffe restoring felon rights under the current system. “He certainly has the constitutional authority to do that one by one,” says Bell. He does object that confirmation of victim restitution is no longer required and that felons on unsupervised probation can vote.

And to the frequently cited adage that Virginia’s hurdles to felons voting are to disenfranchise African-Americans, Bell says, “That simply isn’t historically accurate. That has been part of the Virginia constitution since 1830.”

With the November presidential election looming and Virginia very much a purple state, the lawsuit was filed with the Supreme Court of Virginia to get an immediate response without having to go through the appeals process. The suit asks for a decision by August 25 to give registrars time to cancel felon registrations before absentee ballots go out September 24.

“I think everyone involved would like to have it adjudicated as soon as possible,” says Wheeler.

In Albemarle, the number of registration transactions, which can include changes of address along with new voters, is up about 200 percent over the same period last year. “There’s a whole lotta registration going on,” says Washburne. DMV registration “is one of those numbers that jumped off the page.” He believes that’s because more people are comfortable registering online.

In the city, Bencoach is seeing higher registration than in 2008 and 2012. She’s also seeing something else. “It really tugs at your heartstrings when someone comes in and says, ‘I’ve never been able to vote before,’” she says.
