License to bully?: Local nonprofit stations say Saga is out to bankrupt them

Last month, corporate radio giant Saga Communications petitioned the Federal Communications Commission to deny license renewal to five small, nonprofit Charlottesville stations. It’s a move one station owner calls “a blatant attempt at economic bullying through litigation” that if successful, would shut down the area’s only progressive talk radio and programming geared toward African American audiences.

Saga Communications, headquartered in Grosse Pointe Farms, Michigan, is the parent company of local radio stations WINA, 3WV, and The Corner. Saga earned nearly $125 million in 2018 and owns 79 FM and 34 AM radio stations in 27 markets, Its subsidiary, Tidewater Communications LLC, filed the petition.

Low-power stations have a median range of three and a half miles and were created to foster community radio during a period of massive radio consolidation, following the deregulation of broadcast companies under the 1996 Telecommunications Act.

The five low-power stations—WPVC 94.7FM progressive talk, WXRK-LP 92.3 Rock Hits, WVAI-LP 101.3 Jamz, and oldies stations WREN-LP 97.9 and WKMZ-LP 96.5 in Ruckersville—are independently owned.

Because four of them share space in Seminole Square, Saga says they have a management agreement, which is an FCC no-no. Saga also contends the stations air commercials rather than underwriting announcements, run simulcast programs, and filed applications that are “rife with false certifications,” according to the petition.

WNRN founder Mike Friend owns WXRK-LP, and he’s the first of the five stations to file a response in opposition to Saga’s petition. “It’s legal junk” and a deliberate “misinterpretation” of FCC rules, says Friend. He raised money on air to hire an attorney.

Friend says Saga has gone after low-power stations before. In 2015 Saga petitioned the FCC to revoke the license of WLCQ-LP, a Christian contemporary station in Feeding Hills, Massachusetts, for equipment violations.

And in 2004, Saga alleged that KFLO-LP in Jonesboro, Arkansas, was violating its non-commercial license by airing announcements that “sound suspiciously like commercials,” according to Wikipedia. The FCC “admonished the station,” but denied the rest of Saga’s complaint.

“They think there’s a finite pie of ad dollars that they think they deserve,” says Friend. “If we went off the air tomorrow, 3WV would not gain a single listener.”

The allegation that stung WPVC owner Jeff Lenert the most was Saga’s claim that the stations provide no community good or services. “I cannot stand by while they say we do nothing,” he says, listing his station’s public service efforts, including 21 hours a week of the area’s only Spanish-language broadcasting.

“We’ve had an immigration attorney on air to take questions,” he says. “We really focus on women’s health in the Hispanic community.” And the station just partnered with a nonprofit to provide 1,400 backpacks to kids going back to school.

In the midst of dealing with the Saga petition, he says “pro-Confederate statue folks” have been contacting his station’s underwriters with “implied threats.”

By having to hire a lawyer, Lenert says his expenses have tripled and his revenues decreased because of his underwriters “fear of retribution” from the “neo-Confederates.”

Lenert compares Saga going after his tiny station to “The New York Times coming after C-VILLE.” He says, “Their intent, from my perspective, is to drive us into bankruptcy.”

On the plus side, people have been calling and coming into the station “telling me how unfair this is,” he says. The number of people listening has gone up, as have donations, he adds.

“Shameful,” says City Council candidate Michael Payne about the Saga petition on Facebook. “Corporate attacks on local media outlets are a threat to a robust free press and local democratic debate.”

Christina Dunbar-Hester is a University of Southern California professor who wrote Low Power to the People: Pirates, Protest, and Activism in FM Radio Activism. She says the Saga petition “does strike me as basically harassment because they have more resources.”

“The threat of pulling licenses sounds like someone knows that’s going to be very stressful and burdensome for those organizations,” she adds.

While the FCC wants to make sure low-power stations are independently owned, there’s an “economy of scale” for small stations sharing resources, says Dunbar-Hester.

“We are nothing more than roommates,” says Lenert about the other stations.

The most serious Saga allegation, says Dunbar-Hester, is blurring the line between underwriting and commercials.

Lenert says that’s “easily fixed.” And Friend says, “We maintain otherwise.”

Nathan Moore, general manager of WTJU, says the FCC typically levies fines that hurt, but are payable. “They renew pretty much everyone unless it’s totally egregious.”

He notes, “David might not be perfect, but no one roots for Goliath.”

Saga attorney Gary Smithwick declined to comment about the petition. And WINA general manager Mike Chiumento, who oversaw the monitoring of the LP stations’ underwriting announcements, did not respond to a call from C-VILLE.

A footnote in Saga’s petition makes clear that competition is a concern. “Whether the renewal applicants are abusing their non-tax status is beyond the scope of this petition or the jurisdiction of the commission. Yet, the competition of an entity that does not pay federal taxes with business entities like Tidewater is grossly unfair.”

Uprooting radio: At WTJU’s new home, DJs spin records to break a record

The broadcast to WTJU listeners on the afternoon of Saturday, March 23, began with one DJ announcing to a sea of others, “Here’s Ol’ Blue Eyes, spreading the news that we’re leaving today—Lambeth, that is,” followed by a snippet of Sinatra’s iconic “New York, New York.”

It was the first day of operations in its new Ivy Road home, and local station WTJU packed 82 announcers into the space. The crowd was diverse, composed of both student DJs and locals, but everyone had a common cause—to christen the new location with a momentous, Guinness World Record-breaking feat. Within two hours, each of the participants would sit in the announcer’s seat for less than a minute to introduce themself and play a sample of a chosen song, in a madcap game of music-lovers musical chairs.

Nathan Moore, WTJU’s general manager, admits that the record-breaking stunt was his idea, but the move to Ivy Road wasn’t. About two years ago, Moore was informed by UVA student affairs and housing that the station’s longtime location within Lambeth Commons, a home it had held for 19 years, must be vacated. “We hunted around for a lot of different spaces,” he says, but soon realized that not many spots in the city could accommodate WTJU’s needs. “Where can we find at least 2,500 square feet that we have round-the-clock access to, that students can get to readily, that can be slightly noisy…that has parking, that has visibility?”

Moore was pleased, and a little relieved, to find the Ivy Road real estate, which once housed beloved indie video store Sneak Reviews. Instead of DVDs, the building’s walls are now lined with WTJU’s massive record collection, most of which is housed on the second floor. While Moore is excited about this area, his passion is focused on the first floor, which he expects to be conducive to community building—an essential component, in his opinion, of the station’s future. “We have to be more than just a great place to spin records,” Moore says. “We also have to be a place where people experience music and arts and connection.”

Saturday’s event certainly fit this vision. The DJs took turns jostling their way to the microphone, contributing tunes and cracking jokes. The humor was unfailingly corny, but the music proved a bit more diverse. Aside from Sinatra, everything from k.d. lang to Still Woozy got airtime. The genres spanned classical to K-Pop, and local artists got some love too, whether a classic Landlords track or a song from Alice Clair’s new album—played by Clair’s mother and dedicated to the musician herself, present in the crowd.

The stunt was successful, beating previous record holders by 22 DJs, but it doesn’t erase the fact that some members of the radio community have concerns about the move. Audrey Parks (or DJ Al), a second-year at UVA and a co-rock director for WTJU, says she understands both the student perspective and the administrative side. As a local with a few years of radio under her belt, she also grew to love the Lambeth location. “I feel like the old station had such a personal value for me,” Parks says.

One of the students’ main worries—the distance from Grounds to the new location—is on her mind too. “For the late-night shows…that would be a pretty scary hike.” But even at Lambeth, she points out, “it was also kinda scary going back through frats at that time.” And she’s a fan of the move in that it sets WTJU apart as a community landmark. “It’s an interesting process‚ you know, still making it a UVA space, but being part of the Charlottesville community too.”

The station has become just as essential to the city as it is to students. Professor Bebop, aka Dave Rogers, hosts of one of WTJU’s longest-running shows—he initially got involved in 1973—and has witnessed several moves. “We were in Humphreys, the basement…then we moved to Peabody Hall,” says Rogers. Next was Lambeth, and now Professor Bebop finds himself spinning his signature mix of rhythm and blues on Ivy Road.

He says that the previous location changes “didn’t change the flavor of what we were doing.” Strong leadership is essential to keeping the same spirit, he adds, praising both former manager Chuck Taylor and Moore. “He continues to come up with great ideas that are really amazing ways of reaching out to community,” Rogers says, referring to Saturday’s event. “You’ve got people who haven’t been back in 15 years who came in to do this.”

The station will host its annual rock marathon from April 8-14. This year’s fundraiser T-shirt is a design by award-winning syndicated (and C-VILLE Weekly) cartoonist Jen Sorensen, and fans of Bowie, the Beatles, and Frank Zappa will be happy to hear that entire shows are planned around those artists’ music.

Change is inevitable, it seems, especially for a media outlet that wants to remain relevant and available to the community. And if their record-breaking event is any indication, the DJs of WTJU aren’t going to let a detour down Ivy stop their weird, eclectic mix of music from reaching Charlottesville. As Moore said near the end of the 82-person broadcast, “There are scant few institutions that still bring people together in genuine ways, in genuine community connections—and we’re that. We’re one of them.”

YOU issue: Cities vs. counties

Here’s what readers wanted to know:

The whys of independent cities appear to be a burning issue over at WTJU, from whence these two inquiries came—although GM Moore assures us he and Moltz were not in cahoots with the questions and that this is not an official WTJU inquiry.

Here’s what we know: Out of 41 independent cities nationwide, 38 are in Virginia. These cities got charters from the General Assembly and are not part of the surrounding counties—in our case, Albemarle.

In England around the time this country was founded, entities like the Dutch East India Company were created as corporations and given special powers. Former mayor Frank Buck says cities in the new Virginia colony, which was largely developed by the English, followed that model. Cities went to the legislature to ask for an act to incorporate as independent bodies, while counties were land grants and considered part of the state government, he says.

Cities had more power and could facilitate growth by annexing land, which did not make surrounding counties like Albemarle happy.

That became the genesis of the revenue-sharing agreement, the question we thought we would get from readers but didn’t. We’ll take this opportunity to explain anyway.

Charlottesville wanted to annex land on U.S. 29 north to the Rivanna River, east to Pantops, south to I-64, and west to Farmington, says former city manager Cole Hendrix. Not surprisingly, Albemarle was freaking out with the potential loss of land—and tax revenue—in its urban ring.

So City Council and the Board of Supervisors sat down to find an alternative, and revenue-sharing, in which Albemarle pays 10 cents of its property tax rate to Charlottesville every year, was the agreed-upon solution and was approved by the county voters in 1982.

Ironically, five years later in 1987, the General Assembly put a moratorium on annexation. But Albemarle was still stuck paying out millions to Charlottesville every year.

“Newcomers come into town and say, ‘This doesn’t make sense,’” says Hendrix. Nonetheless, Albemarle can’t get out of it unless the city and county merge, they mutually agree to cancel or alter the agreement, or the General Assembly decides to change the concept of independent cities and make them part of a county’s tax base.

Delegate Steve Landes added a budget amendment in 2017 that would have invalidated the agreement, but ended up withdrawing it because of unintended consequences to other localities. This year, he carried a bill that was signed into law and requires localities like Charlottesville to report how it spends the money, and for city and county to talk annually.

The revenue-sharing agreement led to a petition for Charlottesville to revert to town status in 1996 because of declining revenues. That would have allowed the city and county to combine duplicate government services like schools and police. “No one wanted to do that” as far as the schools, says Hendrix.

He points out the two jurisdictions do have joint agreements for services such as the airport, Rivanna Water and Sewer, and libraries.

Here’s another city/county divide factoid: “The original Grounds of the University of Virginia by fiat were in the county,” says Hendrix. When UVA began buying land in the city, it took that property off the tax rolls. “We had a gentleman’s agreement with the university,” he says: If the land was for educational purposes, it wasn’t taxed. If it was for non-educational purposes, for example, a football field, UVA paid taxes on it.
